Smart Alec Privacy Policy

At Quedify Inc. (dba Smart Alec, “Smart Alec,” “us” or “we”) we take seriously the privacy of students, tutors and others who visit our site (at www.smartalec.com, “Site”), and related web and mobile applications (“Application”) for online tutoring scheduling, coordination and management (together with the Site and Application, “Service”). This privacy policy is designed to help you understand how we collect, transmit, and store information about users (“Users”). The terms “you,” “User,” shall refer to students scheduling and receiving tutoring services (“Students”), tutors who use the Service to setup tutoring sessions (“Sessions”) and manage their tutoring activities (“Tutors”) and any person or entity who views, uses, accesses, or submits any content to the Service. If you provide information to the Service you are doing so voluntarily and in doing so and using the Service you are accepting this Privacy Policy. If you do not agree to the terms and conditions of this Privacy Policy, do not use the Service.

Information We Collect

The Service facilitates personal, one-on-one tutoring services. To enable your use of the Service, we collect information submitted by Users in connection with their use of the Service, including personally identifiable information (“PII”). Such information includes your name and contact information submitted when you create an account with the Service or edit your profile, content that you may upload into the Service, school and other educational information about Students, Sessions information, information gathered as part of your participation in interactive features of the Service, information we receive from third party sites you may use to connect with us, information you provide when contacting us for Service support, or information you store within the Service when communicating with others via the Service. For Students and their parents, we may collect information related to your documentation of and payment for Sessions; tutoring questions related to homework or your studies; Tutor feedback of a student (once the parent provides consent for submission); and content you upload for the purposes of transmitting it to another User, a Tutor, or for public display on the Site. For Tutors, we may collect your Social Security number (SSN) or Federal Employer Identification number (FEIN) and date of birth, for tax purposes or to complete a background check; we also collect content you upload for purposes related to transmission to other Users or public display on the Site. As detailed in the “Data Transmission and Storage” section below, we use Secure Socket Layer (SSL) encryption on any page in the Service where we ask you to submit personally identifiable information, and encrypt all such information in storage using a highly secured, tier 1 third party data center.

We also gather “Usage Data,” defined here as encoded, anonymized information or aggregated data that we may collect about a group or category of services, features or users which does not contain PII. We use Usage Data to better understand and enhance the user experience of the Service. When sharing Usage Data with our third party service providers we ensure that such data cannot be used to identify a unique individual. Some browsers allow you to indicate that you would not like your online activities tracked, using “Do Not Track” indicators (“DNT Indicators”), however we are not obligated to respond to these indicators. Presently we are not set up to respond to DNT Indicators. This means that we may use latent information about your online activities to improve your use of our Service, but such usage is consistent with the provisions of this Privacy Policy.

Information we collect from other sources

Smart Alec may also obtain information from other sources and combine that with information we collect through the Service. For example, we may collect information about you from other users, identity verification services, credit bureaus, mailing list providers and publicly available sources. If you log into your account through sign-in services, like Facebook Connect or Google Authenticator, you grant Smart Alec permission to access certain information about you such as your Facebook User ID, user profile, friends list, user graph and profile picture. User generated content posted through certain social networking preferences (e.g. pages you “Like” or “Follow”) may be viewed by the general public. Therefore, Smart Alec cannot ensure the privacy of any PII included in such User generated content.

Location information

When you use the Service via your mobile device, we utilize Global Positioning System (GPS) technology to collect your geolocation information. In such event, the Service will share such location information with other Users to allow them to determine which Users in their network are nearby. Smart Alec may also use location information to provide Service information and Service options to Users. If you do not want us to use your geolocation information, you may do so by adjust your browser and/or device setting to prohibit sharing of geolocation information.

Data transmission and storage

Smart Alec uses industry-standard encryption when collecting and transmitting your information through the Service. We also encrypt your information when stored in our database. Our database is stored by a tier 1 data center service provider that employs world-class data storage and protection practices, including 24/7/365 on-premise security, biometric and other advance identification mechanism, and advance technological means to monitor data breach risks and prevent such breaches from occurring. These practices and processes are regularly audited under industry-leading auditing standards. In addition, we also uses firewalls and hardware monitoring across our Service to protect against unauthorized access. Even with these measures, Smart Alect cannot guarantee the security of PII, and by using the Service you acknowledge and agree that Smart Alect makes no such guarantee, and that you use the Service at your own risk.

In processing payments from Users for the Service, we do not collect or store any financial information. The service provider we use for processing financial information complies with the Payment Card Industry Data Security Standard.

Use of cookies

Cookies / Tracking Technologies

Technologies such as cookies, beacons, tags and scripts are used by Samepage and our marketing partners, affiliates, or analytics or service providers. These technologies are used in analyzing trends, administering the Site, tracking users’ movements around the Site and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.

We also use cookies to keep an end-users logged into the Service and to remember relevant information when the end user returns to the Service, to understand their preferences and improve their user experience, and track and analyze usage, navigational and other statistical information from visitors to the Site. We may partner with a third party to either display advertising on our Site or to manage our advertising on other sites. Use of Personally Identifiable Information

Smart Alec does not disclose or sell your PII without your consent. We may use PII (i) to provide you the Service; (ii) to process transactions and billing; (iii) for identification and authentication purposes; (iv) to communicate with you concerning the Service transactions, security, privacy and administrative issues relating to your Service subscription; (v) to improve your response to and interaction with the Service; (vi) to do something you have asked us to do, or tell you of Service features that we think may be of interest to you; (vii) in the case of Tutor feedback of a Student, to deliver such information if you so request; (viii) to personalize and improve the Service, and deliver and display offerings relating to the Service, content or features in the Service; and (ix) for administration of and troubleshooting regarding the Service. Certain third parties who provide technical support for the operation of the Service may need access to such information from time to time but are contractually prohibited from disclosing such information to any other party or otherwise use such information in any manner. Smart Alec shares a minimum amount of information between Tutors and Students in order to facilitate the arrangement of tutoring Sessions.

Referrals

If you choose to use our referral service, to tell a friend about our Service, we will ask you for your friend’s email address. We will automatically send your friend a one-time email inviting him or her to visit the Site and up to two reminders. We store this information for the sole purpose of sending this one-time email and reminders and for tracking the success of our referral program. Your friend may contact us at support@smartalec.com to request that we remove this information from our database.

Minors

This Service is not intended for use by children under 13 years of age. Smart Alect does not knowingly collect PII from children under the age of 13. If you are under the age of 13, please do not provide your contact information or any other personally identifiable information to Smart Alec. If you are the parent or legal guardian of someone under the age of 13 who may have provided us with information without your knowledge or consent, please contact us at support@smartalec.com to have this information removed. All contact, including Sessions information, between a tutor and any minor should must take place only in a supervised setting and all our Tutors are have signed agreements with us where they commit to abide by our Privacy Policy and conduct Sessions only in a supervised setting.

Legal requests and business transfers

Smart Alec ma disclose PII to respond to valid subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims. We may also share such information if we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Service, to an acquirer of Samepage or our affiliate companies, or as otherwise required by law.

Your choices

You are responsible for maintaining the security of credentials used to access the Service. Please maintain such credentials secure and never share your name and password with any other person. If you think your password may have been compromised, please change it immediately or contact Smart Alec for additional assistance.

Smart Alec may send you email communications periodically detailing new features or promotions on the Service. You may unsubscribe from these messages by using the link at the bottom of the email. We may also send you email messages about the status of your account or any notices as required by law. You may not opt-out of receiving these administrative emails so long as you continue to use this voluntary service. If you wish to terminate your account, please contact us.

Your California Privacy Rights

California law permits users who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed Users’ PII for their direct marketing purposes in the prior calendar year, as well as the type of personal information disclosed to those parties. If you are a California resident and would like to request this information, please submit your request in an email to legal@smartalec.com.

Privacy policy changes

Smart Alec reserves the right to revise this Privacy Policy from time to time to adjust to changes in the Site, Service and as we add new offerings and features. We will post any changes here and indicate the new effective date of the Privacy Policy at the top of the document. We encourage you to review the Privacy Policy for any updates while you are an active User of the Service.
